International Transport Liability Terms & Conditions

Flash Cargo Inc. — International Freight Forwarding & Customs Brokerage
All transportation services arranged or provided by Flash Cargo Inc. (“Company”) are subject to the terms, conditions, limitations of liability, and defenses set forth in applicable international conventions governing the carriage of goods, including but not limited to:
- The Hague-Visby Rules (Carriage of Goods by Sea)
- The Montreal Convention (International Air Carriage)
- The CMR Convention (International Road Transport)
These conventions apply according to the mode of transport used for each shipment and are incorporated herein by reference.
🌊 Ocean Freight — Hague-Visby Rules
For shipments transported by sea, liability shall be governed by the Hague-Visby Rules, which limit the carrier’s liability for loss or damage to cargo and define rights, obligations, and defenses available to carriers and intermediaries.
✈️ Air Freight — Montreal Convention
For international air carriage, liability is governed by the Montreal Convention, which establishes uniform rules for carrier liability, including limits for cargo loss, damage, and delay.
🚛 Road Transport — CMR Convention
For international road transport between contracting countries, liability shall be governed by the CMR Convention, defining carrier responsibility and limitation of liability for goods transported by road.
🧭 Multimodal Transport
Where transportation involves more than one mode of carriage, liability shall be determined by the convention applicable to the stage of transport where the loss or damage occurred. If such stage cannot be identified, the most restrictive liability limitation shall apply.
🛡️ Limitation of Liability
Flash Cargo Inc. acts as a logistics coordinator and intermediary unless otherwise agreed in writing. In no event shall Flash Cargo Inc.’s liability exceed the limits established under the applicable convention governing the relevant leg of transport.
The Company shall not be liable for indirect, consequential, or economic loss including, but not limited to, loss of profit, market, or use.
📦 Cargo Insurance
Unless expressly agreed in writing, Flash Cargo Inc. does not provide cargo insurance. Shippers are strongly advised to procure appropriate insurance coverage for all shipments.
⚖️ Governing Law
These Terms & Conditions shall be governed by the laws of the State of New York, together with the applicable international transport conventions referenced herein.
