These conventions apply according to the mode of transport used for each shipment and are incorporated herein by reference.
For shipments transported by sea, liability shall be governed by the Hague-Visby Rules, which limit the carrier’s liability for loss or damage to cargo and define rights, obligations, and defenses available to carriers and intermediaries.
For international air carriage, liability is governed by the Montreal Convention, which establishes uniform rules for carrier liability, including limits for cargo loss, damage, and delay.
For international road transport between contracting countries, liability shall be governed by the CMR Convention, defining carrier responsibility and limitation of liability for goods transported by road.
Where transportation involves more than one mode of carriage, liability shall be determined by the convention applicable to the stage of transport where the loss or damage occurred. If such stage cannot be identified, the most restrictive liability limitation shall apply.
Flash Cargo Inc. acts as a logistics coordinator and intermediary unless otherwise agreed in writing. In no event shall Flash Cargo Inc.’s liability exceed the limits established under the applicable convention governing the relevant leg of transport.
The Company shall not be liable for indirect, consequential, or economic loss including, but not limited to, loss of profit, market, or use.
Unless expressly agreed in writing, Flash Cargo Inc. does not provide cargo insurance. Shippers are strongly advised to procure appropriate insurance coverage for all shipments.
These Terms & Conditions shall be governed by the laws of the State of New York, together with the applicable international transport conventions referenced herein.
